Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the LivePlay Hosts platform, including the website at www.liveplayhosts.com and the LivePlay Hosts mobile application (collectively, the "Service"), operated by LivePlay Mobile, Inc. ("LivePlay," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility and Access

The Service is a private workforce management platform available exclusively to authorized LivePlay Mobile team members. Access requires:

  • Submission of a host application through the LivePlay Hosts website
  • Approval by LivePlay management
  • Creation of an account with valid credentials

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this age requirement and that the information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Keep your password secure and not share it with others
  • Notify LivePlay immediately of any unauthorized use of your account
  • Keep your profile information accurate and up to date

LivePlay reserves the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

4. Acceptable Use

You agree to use the Service only for its intended purpose of workforce management and communication related to your role at LivePlay Mobile. You may not:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Share your account credentials with any unauthorized person
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious software, viruses, or harmful content
  • Use automated tools to scrape or extract data from the Service
  • Share confidential company information obtained through the Service with unauthorized parties

5. Scheduling and Shifts

The Service provides tools for managing your work schedule, including shift assignments, call outs, and shift pickups. You understand and agree that:

  • Shift assignments sent through the platform require your acceptance or decline within the specified time period (typically 48 hours)
  • Failure to respond to a pending shift within the deadline may result in the shift being reassigned
  • Call out requests are subject to approval by management
  • Schedule information displayed in the app reflects data from LivePlay's scheduling systems and may be subject to change

6. Pay and Finance

The Service provides a pay review feature that displays your shift history and estimated earnings. This information is provided for review purposes. Final pay amounts are determined by LivePlay's finance team. The pay review feature does not constitute a binding pay agreement, and actual compensation is governed by your employment or contractor agreement with LivePlay Mobile.

7. Training Content

Training materials, courses, and related content available through the Service are proprietary to LivePlay Mobile. You may access and use training content solely for the purpose of fulfilling your role at LivePlay. You may not copy, distribute, reproduce, or share training content outside of the platform without written permission.

8. Video Conferencing

The Service includes video conferencing features ("Video Booths") for live communication during shows. By using Video Booths, you consent to:

  • Your camera and microphone being activated during video calls
  • Real-time transcription of audio during calls (when enabled)
  • Being visible and audible to other participants in the same booth

Video booth calls may be recorded when cloud recording is enabled by an administrator. You will be notified when recording is active.

9. Notifications and Communications

By using the Service, you consent to receive work-related notifications through the following channels:

  • Push notifications on your mobile device
  • Email to your registered email address
  • Slack direct messages
  • SMS text messages (if you provide a phone number; see our SMS Terms)
  • Google Calendar invites

You can manage your notification preferences through the Communication Preferences section of the app. Some critical work notifications may not be fully disabled while you maintain an active account.

10. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by LivePlay Mobile, Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This license does not grant you any rights to modify, distribute, or create derivative works based on the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. LivePlay does not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, LivePlay Mobile, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, scheduling errors, or notification delivery failures.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the platform or sending a notification. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
